Question: How will my contribution be used?
Answer: To support the appeal. Plaintiffs' attorneys will present us with itemized bills for approval before we commit your funds. The big-ticket items are the printing costs. Parties are expected to have multiple sets of their briefs and the Record on Appeal printed and bound in volumes. The Record in this case is very extensive.
Question: If we win, will I get my contribution back?
Answer: If the District Court's Decision is reversed on appeal and there is ultimately a recovery or settlement in the case, typically expenses are reimbursed off the top. In this instance, that would probably mean that the appeal costs would be reimbursed to plaintiff-appellants' attorneys. Those attorneys have confirmed that it would be their intent, in turn, to reimburse the "wewantourmoneyback.net" fund. It would be our intent to reimburse you. (That is, as long as you give us sufficient information to enable us to find you and keep that information current.)
Please note, however, that if the District Court's decision is affirmed on appeal or there is never a recovery, settlement, or recoupment of costs, there would obviously be no reimbursement.
Question: Is it possible to contribute anonymously?
Answer: If that's how you want to contribute, we will gladly accept the donation. Obviously, however, if you don't give us your name and contact information, there would be no way for us to ever reimburse you, should that possibility arise.
Question: Who will be benefited by the lawsuit?
Answer: The litigation was brought as a class action with the intention of benefiting more than 20,000 flight attendants who are not personally named in the lawsuit. But, no class has as yet been certified and it is not certain one ever will be. If we are able to win on appeal and get the case sent back to the District Court for further proceedings, it is our intent to make plaintiffs' motion to certify a "Class" the first order of business there. Assuming a class is ultimately certified, it will be defined by the Court at that time. Obviously, however, precisely how many flight attendants would be covered by the Class-as-certified - and who would be included - we cannot say. It is our intention to benefit as many as possible.
Question: Who can contribute to the Appeal?
Answer: Anyone interested in the issues involved in the lawsuit. Anyone interested in justice for employees who work in the Airline or Railroad industries. Anyone interested in justice generally.
